CR.NO.126/2016 (S.C.NO.5006/2017) OF KODIGENAHALLI P.S.,
TUMKURU DISTRICT FOR THE OFFENCES P/U/S 498A, 306 OF
IPC.

ORDER

Heard the learned counsel appearing for the

petitioner/accused and the learned High Court Government

Pleader appearing for the respondent.

2. The respondent-police charge sheeted the

petitioner in their Cr.No.126/2016 in respect of the offence

punishable under sections 498-A and 306 of IPC.

3. The case of the prosecution is, deceased Jyothi

married to the petitioner though he is a married person. He

abused the deceased physically, mentally and verbally and

insisted her to commit suicide. Unable to bear the torture,

she committed suicide by hanging on 29.12.2016 in the

construction site of petitioner’s father.

4. As per the prosecution case itself, the deceased

was not in touch with her parents since she had married a

person on her own who is already married. The

investigation since complete, there is no impediment to

allow the petition.

Accordingly, the petition is allowed. Petitioner is

enlarged on bail in Crime No.126/2016 of respondent-

police, subject to the following conditions:

(i) He shall execute a self bond for a sum of
Rs.1,00,000/- with one surety for the
likesum to the satisfaction of the
concerned Court.

(ii) He shall attend the Court on all hearing
dates regularly and punctually.

(iii) He shall not terrorize the prosecution
witnesses.
