It is submitted on behalf of the petitioner no

effective investigation was made into the unnatural

death of her daughter and ‘streedhan’ articles have also

not been recovered.

It has been alleged in the first information report

that the victim was married to one Sk. Omar Alo and a

sum of Rs.20,000/- and two bhories of golden

ornaments were demanded at the time of marriage. It is

further alleged that on 22.12.2016 at 11 a.m. the

petitioner was informed that her daughter had died at

the matrimonial home. The petitioner came to the

matrimonial home of the victim and found that she had

suffered several injuries on her body and consequently

suffered an unnatural death.

On the complaint of the petitioner, Khandogosh

P.S. Case No. 350 of 2016 under Sections

498A/302/304B/34 of the Indian Penal Code read with

Section 3/4 of the Dowry Prohibition Act was registered

for investigation.

Pursuant to investigation accused persons were

arrested and subsequently were enlarged on bail.

In conclusion of investigation, charge-sheet being

Khandaghosh P.S. Charge-sheet no. 79/17 dated

30.03.2017

under Sections 498A/304B/34 IPC and

Section 3/4 of the Dowry Prohibition Act has been filed

against the accused persons. Report be kept with the

record. Copy of the report be handed over to the learned

counsel for the petitioner.

In view of the such development, it is open to the

petitioner to appear before the criminal court as victim of

crime and agitate her grievances therein in accordance

with law.

With the aforesaid observation, the petition is

disposed of.
