Heard learned counsel for the parties.

After perusing the findings given by learned trial court
coupled with the evidence on record for acquittal for the offence
under Sections 498A and 304B I.P.C., in our opinion,
reconsideration of the opinion is necessary and proper and the
same is accepted.

Leave to appeal is accepted.

The memo of appeal is treated as appeal against the
judgment impugned dated 14th July, 2016 passed by the Additional
Sessions Judge, Jaitaran, District Paliin Sessions Case No.8/2014.

The respondent is directed to furnish personal bond of
Rs.25,000/- with one surety of like amount to the satisfaction of
Dy. Registrar (Judicial), Jodhpur on or before 7 th July, 2017 and
after furnishing the same, he shall remain present before the
Court as and when required.

Admit.

Put up in due course.
