Section.59. Removal of difficulties.

1[59. Removal of difficulties

 

(1) If any difficulty arises in giving effect to the provisions of this Act, particularly in relation to the transition from the enactments repealed by this Act to the provisions of this Act, the Central Government may, by order published in the Official Gazette, make such provision not inconsistent with the purposes of this Act, as appear to it to be necessary or expedient for removing the difficulty.

 

(2) An order under sub-section (1) may be made so as to have retrospective effect from the date not earlier than the 1st day of December, 1961.]

 

COMMENTS

 

The following orders have been passed so far:—

 

(1) Advocates (Removal of Difficulties) Order, 1963 (w.e.f. 1-9-1963) vide Gazette of India, Extra., Pt. II, sec. 3(ii), p. 513, dated 31st August, 1963.

 

(2) Advocates (Removal of Difficulties) Order No. 2, 1963 (w.e.f. 1-10-1963) vide Gazette of India, Extra., Pt. II, sec. 3(ii), p. 879, dated 21st December, 1963.

 

(3) Advocates (Removal of Difficulties) Order, 1966 (w.e.f. 1-11-1965 vide Gazette of India, Extra., Pt. II, sec. 3(ii), p. 7, dated 10th January, 1966.

 

(4) Advocates (Removal of Difficulties) Order, 1968 (enforcement at once) vide Gazette of India, Extra., Pt. II, sec. 3(ii), p. 127, dated 23rd February, 1968.
