ACT NO.25 OF 1850

1THE FORFEITED DEPOSITS ACT, 1850

An Act for the forfeiture to Government of deposits made on incomplete sales of land under 2 Regulation 8, 1819 3

1. Short title given by the Amending Act, 1897 (5 of 1897), s.4 and Sch. III.

2. The Bengal Patni Taluks Regulation, 1819.

3. The words and figures “and Act 4, 1846” rep.by Act 12 of 1891, s.2 and Sch.I, Pt.I.

Since this Act supplements the Bengal Patni Taluks Regulation, 1819 (8 of 1819), it must be taken to have been passed, like that Regulation, for the whole of the former Province of Bengal.

The Act has been declared, by notification under the Scheduled Districts Act, 1874 (14 of 1874), s.3, to be in force in the Districts of Hazaribagh, Ranchi, Palamau and Manbhum and Pargana Dhalbhum and the Kolhan in the District of Singbhum in the Chota Nagpur Division.see Gazette of India, 1881, Pt.I, p.504.

The Act has also been declared to be in force in Sonthal Parganas by the Sonthal Parganas Settlement Regulation (3 of 1872), s.3 (1) and Sch.

Preamble.

WHEREAS patnidars 1[****] fraudulently avail themselves of the 2[*****] provision in section 9, Regulation 9, 1819, of the Bengal Code 3[****] that forfeited deposits at sales of land 4[***] for arrears of rent shall be applied as if they were purchase-money; It is enacted as follows:—

2. Application of forfeited deposits.

Any such forfeited deposit shall be applied to defray the expenses of the sale, and the surplus shall be forfeited to Government.
