498A forced me to come back to India 9 Times in last 7 years

This 498A forced me to come back to India 9 Times in last 7 years; but she never came to single date and judge never questioned her nor demanded to produce her. This is the best example for partiality in our Law system.
I left India after 6 months of this 498A, as there was no progress in my case; it was filed on 4th July 2000. within a month my lawyer used to tell, judge will cancel my Bail and make it Non bail able, so I came back first time within one month I left India on 26th January 2001.
The day and same time when I set foot back in India; there was earthquake Bhuj – Kutch. I landed at Bombay AirPort at 8.10 or something and 26th January was my Son Birthday also; at afternoon I called her sister House where she was residing with Glenn; when I called I heard merry and music, I did`t uttered single word I just disconnected the phone.

I went back Abroad on 2nd February 2001, After Canceling my Warrant.
Again after 3 month my lawyer said Warrant is issued again so came back again on 19th April 2001. after canceling warrant I went back on 27th April 2001. but there was no progress in my case, as she never came to court, still judge issued warrant again and it forced me to come back after just after 6 months on 1st November 2001, and returned back 12th November 2001.
It was third time in single year I came back to India spending 40 Thousand on single trip. When I left I decided not to come back, as I was not getting any dates; whenever my court date comes that day judge was on leave or my number was never called to appear. I came back again on 13th June 2002 when court issued 4th Warrant; I waited whole month hoping to get a date and I can explain my situation to judge; but judge did not asked anything nor my lawyer allowed me to talk and my trip gone waste.
So I returned after one month on 11 July 2002. when I returned I did`t know what was the next court date; so my friend called lawyer; he shouted at my friend who was helping me; coz I did not told him that I’m leaving.
My Lawyer always threatening me so I decided to cancel my visa and resign job. on 31st October 2002 I came back only after 3 months resigned my well paid job, thinking if I stay back something will happen; I waited for 2 months but I got only one date; as soon as judge saw me he gave another date, as she was not there.

I lost my job because of this 498A, when I learned nothing will happen if I’m there or not I decide to go back and find another job, But that was not so easy; still I went back to on 17th December 2002, hoping to find another job, within a month my lawyer said judge want to meet me, so I came back again 19th January 2003. I waited for 3 months till 26th April 2003, as I got only 2 dates and I told judge that she is also gone out of country and asked him not to issue warrants unless she comes here.

When I left I decided at any cost whatever happens, not to come back again and again, still whenever judge asked me to be present I came even after this. So this 498A, forced me to come back 9 Times in 7 years, till date.

  1. Rudy sir, why you are allowing this nuisance to continue like this for ever ? Get this quashed and say good bye to this crap. Why you are taking this slow poison when she is enjoying life ? Pls do a noble thing to yourself. Get rid of this case soon.

  2. Hi could you pls suggest how did u manage to get the passport in 498a. Coz my most of the family’s passport in court custody and i am abroad.

    How one can go back to abroad and continue his job during 498a. Does court allow you to go abroad and continue your job during 498a?

    Appreciate your quick feedback in this regards

As you are not charged with any crime other than allegation, no court has Authority to keep your passport, and under Constitution of India you have right to livelyhood use both option and apply to HC to get passport with promise you will be available whenever court really need you. there is judgement also in DOCS where your presence is not required always.

    Thanks for this valuable info. Pls share the judgement or let me know from where i can download it. since 3 years we havent visited india with a fear that our passport will be taken by court and will not be returned unless the case gets solved. Also if u can give your contact details to varify few doubts.
