      If there is a complaint under 498a and one has documents and evidences that the Dowry case is false, can he file a case against the opposition for blackmailing and harassment???

      certainly yes… why not?? if you have proofs which clearly says that case is false then one should go for quash and then for criminal defamation along wtih civil defamation.

      however, can one blindly trust the system and integrity of the ones who are responsible for it….Sad bt tru.

      Dear friend,

      Jai Hind.

      I have gone through your problem, if your wife has filed case u/s 498(a) or any and if it is false , you have to prove it through your lawyer & if it will prove, you will be discharged from the said offence , then after you have right to file crimnial case for malacious prosecution , defamation and also you may claim for damages also.

      I did not get married. It all happened before marriage.

      A false complain has been lodged and as i refused to pay a case may be filed. I am willing to fyt till the end.
