      After a Talak (Muslim Personal Law), Can a wife file a 498 A and DV simaltaneously?

      The accusations made in both cases are same but my father is accused in 498 A whereas he is not accused in DV. Four people are accused (me, my elder sister and my parents), but there is no eveidence for any of the accusations that they have provided in court for both cases.

      One more thing is the wife in this case is a mental patient and was undergoing psychiatric treatment while we were married. i did not know that she had any illness before marraige. i have submitted relevent documents of the treatment to courts.

      1. In DV, as there is no evidence brought up against me that any violence occured what will Judge interpret?

      2. Same with 498 A. No evidence so far.

      we all are out on bail.

      I have given a Talak as we were married according to muslim religion. Both cases were filed 2 months after the talak which clearly means they are out to get Money as well as to Harasse us.

      What should be my course of action? Any organisation which can help me Thane (Maharashtra) region.

      Yes wife may file criminal cases even after talak and you have to defend the same .

      Hello All,

      Good News – The DV case against me has been dismissed by court. We are yet to get the judgment copy but my Lawyer told me that application submitted by the opposite party has been rejected by the court. Don’t have details of judgment yet as i am out of town.
