But property is a fixed asset. It could be his house. Can’t he claim that he can’t pay any maintenance because of no income ? It is a perfectly valid argument. If his wife has the necessary education to work and has worked before and is only currently unemployed, then where is the argument for maintenance. The Supreme Court has very clearly held that maintenance is only for sustenance of a woman and not an argument because she is currently unemployed. This was a very recent judgement against a woman who was a trained fashion designer and not working. Check out this judgement. This may be of help to you.
