      Hi,

      Pls suggest in the foll case in india:

      The layd filed 498A in 2005 thereafter she filed divorce on the basis of cruelty in 2007. later she filed DV and 125 in 2008. she managed to get a protection order under DV in 2008.

      in the mean time under the divorce proceedings she has given her oral statement and the judge wants us to cross examine her. our request for hiring an advocate for the family court was turned down by them.

      The question is whether cross examination in family court after she has obtained a protection order is not abuse of judicial process since one court is forbidding any mental torture whiole other is giving an opportunity for her to move another application of mental torture dueing cross examination to create problems in DV.

      plse advice and also suggest to delay the divorce proceedings.

      Dear friend, i have gone through your matter, not only your wife but anybody can file any case in any court, we have to defend it through our lawyer & has to prove our innocence. If complainant has false case we have right to file case against complainant for malicious prosecution & for damages.
