      I m NRI and I divorced my wife thru Qazi in India as per Muslim Pesonal law and practice in Feb-2009 while I was in India. After two month by end of April-09 she filed false 498A. Police made accused to me and my father. My father got bail. Now bail petition for me is under hearing. If I get bail, should I travel to India to appear in court to formalise the bail? If I travel India, Can I return to my job without any legal obstacle or objection? Pls reply and advice me. Thanks.

      TALAQ is not valid divorce, you have to get legal divorce; so she can file 498A or DVA on you still.

      if you come to india, obiously they will ask court to stop you from traveling abroad again. and you will be stuck here for long.

      what is her claim in her FIR, if there is any loophole in that you can counter her false 498A.

      I have gone through your matter, If you have released on bail, you dont worry, appoint advocate & ask him to apply for your permanent exemption till trial, & you may go to your job.
