      My 498a wife going to file application u/s319 after her exam.-in -chief for summoning of my parents, married sisters living separately,who were given clean chit in police enquiry. I request the members of this forum to intimate me some landmark judgements of HC/SC, quashing summoning orders of parents, sisters etc. who are living separately, which may be quoted for quashing of summoning orders or may be quoted while filing reply to the application of wife in the court.

      Rajesh Sharma vs State of U.P. in 2017.

      I would rather suggest your to wait for summoning order. If that happens, it’s an opportunity for you to approach Hon’ble concerned High Court u/ s 482 of Cr.P.C. or under article 226/227 of Constitution of India. You can substantiate your claim of misuse of this act in your case as well as you can mention the arbitrary practices being adopted by concerned magistrate.

      Whatever you mentioned sounds violations of your & Your family members fundamental rights and legal rights.
