I WOULD LIKE TO KNOW HOW TO GET BAIL BEFORE A FALSE CASE IS REGISTERED AGANIST ME.DAY AFTER TOMMOROW AT 10AM WE HAVE TO ATTEND THE POLICE STATION FOR A DICISION.
ACTUALLY,WE GOT NOTICE FROM THE ADVOCATE THAT IF WE DO NOT TAKE HIS CLIENT TO OUR HOME BY EXPRESSING APOLOGIES TO HIS CLIENTS.OTHER WISE WE WILL FILE A CASE AGANIST ALL THE FAMILY MEMBERS INCLUDING BY BROTHER IN LAW AND CHILDREN.SO MY ADVOCATE SENT REPLY NOTICE BY INFORMING THAT WE DONT HAVE ANY PROBLEM IF SHE COMES AND STAY WITH US RATHER THAN HAVING A NUCLEAR FAMILY AND SEPERATING FROM FAMILY MEMBERS.
THEN THEY APPROACHED POLICE STATION AND GIVEN A COMPLAINT (WRITTEN COMPLIANT).BUT A CASE MIGHT HAVE NOT FILED YET.SO THAT C.I IS INTIMIDATING ME AND FAMILY MEMBERS THAT IF U DONT TAKLE HER AND SEPERATE FROM YOUR FAMILY MEMBERS U WILL BE PUNISHED SEVERLY.
HE ABUSED ME AND MENTALLY TORTURED ME IN STATION,DAY BEFORE YESTERDAY.BUT I AM STUBORN THAT I WILL STAY WITH NY FAMILY MEMBERS AND CONTINUE FAMILY LIFE IF SHE AGREES BUT AS SHE DENIED THEY ARE PLANNING TO FILE A CASE AGANIST ALL MY FAMILY MEMBERS.
SO PLZ GIVE A REPLY AS TO HOW TO HANDLE THE SITUATION.THEY GAVE ALL THE FALSE ALLEGATION AS SUCH DOWRY,HARRASMENT AND ABUSING HER.INFACT ALL OF THEM ARE FALSE INDEED.
HIS FATHER TOOK TO HIS HOUSE 10MONTHS BACK AND DEMANDING ME TO TAKE HER BY APOLOGIZING AND SEPERATING FROM MY FAMILY MEMBERS.WE HAVE ALREADY AWAY FROM MY FAMILY MEMEBERS AND STAYED FOR 7MONTHS SEPERATELY.BUT AS I AM VISTING MY PARENTS HOUSE EVEN THAT THEY ARE DEMANDING NOT TO VISIT AND BLACKMAILING ME AS THEY WILL BOOOK A CRIMINAL CASE.
ANYHOW NOW I NEED TO KNOW HOW TO COME TO COME OUT OF THIS DUPE CASE.MY ADOVOCATE SUGGESTED TO SURRENDER AND SEND MY FAMILY MEMBERS OUT ON HEALTH GROUNDS.SO THAT THEY WILL FILE A CASE AND THEN I CAN GET BAIL BY USING THAT CRIME ID.
BUT I WOULD LIKE TO KNOW ,CAN I GET A A.B BAIL BEFORE THEY FILE A CASE.MY ADVOCATE IS SAYING THAT ITS NOT POSSIBLE.SO PLZ SUGGEST MY WHETHER I CAN GET A.B BY 2MORO EVENING BEFORE THEY FILE A CASE DAY AFTER TOMMOROW.
HOPE I GET A SOLUTION SOON…………

If you knows that criminal case like 498(a) is registered against you & there is each & every apprehension that police may arrest it is better to approach Hon’ble Sessions or High Court for anticipatory bail immediately prior to arrest.

you can move an application under SEc 438 CRPC,before the sessions court praying for directions to the concerned police station (where the complaint is pending) for giving of a notice of 7 days before arrest after registeration of fir for enabling u to take legal remedy at that time.as it is apprehended that the said complaint may be converted into an FIR at any point of time and thus there is apprehension of ARREST.

Thanks a lot!!!I followed the honour’s reply.I would like to know how much time it takes to get apprehension bail?I applied on friday…so when does the application goes to police station?Today is monday and day after tommorow is court’s holiday on account of Dr.Ambedkar’s birth anniversary.When the application goes to police station what type of precautions should i take.can i go to office and do my routine work as since last 10days i am not going to office (LOP for me).Once it goes to police station my lawyer says that u should not be in notice to police atall.He says if i am caught they will put me behind the bars.plz suggest what precautions should i take to avoid those hurdles.when can i expect the apprehension bail?My lawyer says it may take 10 to 15 days also…..depends in police reply.plz help me to come out of this over this issue…..
