      I got married in 1995 and my wife and I were together for 14 years approx. I am working in a software company and my wife was a housewife and she did her 10th class from Andhra Pradesh. I always felt that we were not compatible to each other and she always used to insult me and my friends visiting my place. After negotiations for around 13 years and realization that she cannot change, I applied for divorce in Jan 2010 in Family Court Pune. To keep my wife and kids comfortable i left my home to them and moved to some other house in Pune. We have accepted for an interim maintenance in Pune court with a condition that she should stay in pune with my kids. I used to meet my kids every weekend and spend time with them. I have received many threatening calls from her relatives that they would put many false cases against me and my brother and parents. I told them that they can do anything but they cannot change my mind as i made up my mind after repeated attempts to change my wife’s attitude and failed. In between they threatened my parents that they would kidnap me. After attending few dates in court, my wife shifted to Vishakapatnam (A city where most of her relatives stay). I stopped paying the maintenance as she didn’t obey the terms accepted in interim maintenance. Now she applied in Supreme Court to transfer the case from Pune to Vishakapatnam. Supreme court has given a ex-party stay order for my petition in Pune. If the case gets transferred they would definitely trouble me. Is there anyway i can vacate the stay in Supreme Court and oppose the transfer. I have heard that the court would normally support female spouse and the transfer would happen. She also filed one more petition in Vishakapatnam for maintenance. Is there any way i can oppose the transfer petition and win against it? Is there any way i can combine both the petitions? Is there anyway i can get the custody of my kids claiming that my wife is not eligible (Because she is just 10th class and she is dependent on my maintenance)

      If your wife approached supreme court, you have to reply her transfer petition & have to submit the facts to the court through your lawyer, i think court will convince, you have not to worry. If relatives of your wife are threatening you, you have to prosecute them, defend yourself.
