Maintenance to BHMS doctor wife running a clinic. She could not provide any document or evidence of my proof or job.
Family court ordered me to pay Rs. 2000 per month.
I have appealed to High court for setting aside the order. Please let me know what will happen.

I have gone through your matter, You have not informed that whether you have engaged your lawyer or not, if not, you do that first & challenge the said order , If your wife has committed offenses you have to prosecute them by filing criminal case, then only you will get relief otherwise they will continue to torture you.

Dear gupta ji,
you have not provided details on your own business or income? Or if you have children? Now Rs 2,000 per month is not very high maint even though we don’t know your case details. If wife is BHMS doctor, you may also be professionally qualified.
What if high court increases it to Rs 6000 per month?

i have shown that I became unemployed due to the criminal case filed by my wife. My wife don’t have any other details. There are no kids. I have challenged the order ( APPEAL) through a lawyer in Chandigrah High court. The lawyer told that he can get a stay order since your wife is earning than me because i am unemployed no compnay want me to employ me because of 498a.
Please advise whether my lawyer is not misguiding me !

you can read on my blog about maintenance: lawyer is correct, your wife doesn’t deserve maintenance. But advice to learn some law yourselves.

My wife has filed false 498a on me ,my parents & 2 brothers. I read about some counter cases against 498a. My 498a case is running since 2002. The other party’s evidence are over. Over evidence will start.
I want to know what are the specific counter cases which can have maximum impact. I don’t know anyone where girl’s party have been punished for filling false 498a cases. Generally groom’s party surrender and ready to pay any extortion money to bride’s party and go for compromise.
If i am able to prove that the case is false ,will the court is going to punish the girl’s party !.

I am so sorry that this case has been running since 2002. Needless to say amount of money you might have spent, time and agony you underwent. Thanks to the highly messed up legal system. What have you been doing all these years? Time is of essence in such cases. Had you counter filed, probably you could have closed this case by now and moved on with your life. Any way, I feel it’s never late. There are lot of counter cases you can file based on your specific situation. That’s the only way you can make her piss in her pants for a false 498a. The first place you got to look is yahoo SIFF group and http://498a.org . You got to attend local SIFF chapter and networking is very important. Do not trust your lawyer blindly. Trust me; most of the lawyers don’t know what they are doing and how to be street smart. Fire him if he is not able to deliver the results and take care of you “in your best interest”. You got to do enough research. 90% is your effort and 10% is of your lawyer. RTI is the biggest weapon you can use. I remember reading lot of cases where maintenance is denied but you got to do your research and give specific instructions to your lawyer with data (using RTI). Wish you good luck.
Lokesh: is it possible to post the URL of this case (where MBBS doctor is denied maintenance) for the benefit of other members? Also do you have any case details where wife is ordered to pay maintenance?
