      Spoke to few lawyers, and then told that even if you apply for mutual divorce and both the parties agree then also it will take minimum 6 months as there has been few judgements recently from Supreme Court, making a 6 month period between 1st and 2nd motion as mandatory.

      Is this correct? can’t these period be waived off, if both the parties want mutual divorce and dont want to wait for 6 month period….

      under Mutual divorce its upto Party; if both ask judge may agree.

      Even in my xparte i got only 1 month waiting period without asking the judge.

      its all upto judge.

      Hi,

      I have been separated by my wife for more than 1 year now. Married in 2004, we have been having a strenuous relationship over all these years; marred by instances where she had earlier left me 2-3 times and

      went to her parent’s house. There are multiple reasons why I think our thoughts and mindset do not meet. I have tried my level best to make her happy as much as possible but her expectations seem to be far from being manageable.

      We have a son who is about 2 years old and she took her along when she left me last year. Even on repetitive requests from me, she is not coming back from her parent’s house.

      What options do I have?

      I would really appreciate your advice please.

      File Restitute conjugal rights, let her answer to court why she is not ready to live with you.

      She has no right to stay away without reason when she is married to you.

      Result of this she may answer with cruelty case (498a / DVA) on you to make her Divorce / mainatenance case stronger.

      and you can file Child Visitation appeal too
