Hello
Good Morning,
I got married in 2009. There was dispute between my wife & me. I filled RCR 2011 in Delhi. Apart from all this, I filled RCR. In my case only dates are moving, there is no result coming out of it. My wife came to court she said that she wants to go back to her husband. now the judge has asked me to court otherwise the case will be dismissed.
What should I do now.
Please let me know ASAP.

tell judge as long as 498a is there its difficult to take her home; you are ready to take her home if she prove her 498A.
Never say you do not want to take her back.

Thank you for your reply. She was asked that she she has done dowry case, that time she had no answer she just said that she has just done it. How much does police take to put up charge sheet in Delhi.

There is a Direction to Delhi police about 498A Investigation;
Please contact our delhi members and talk to them.
chargesheet will depend on how powerfull you are and her side. most of the time within few days some took year also.

As you already have FIR copy; to all her allegations reply in writting to police; and ask them to do proper investigation

I have the FIR copy and some evidences too but i fear the the police might give a copy of my evidences to my wife.
Can I submit evidences to the court or not.
I know Mr. Shonee Kapoor but he is too busy now a days.

I have to know that my wife has given in writing that she wants to go back to her husband. Only this much she has given in writing . Is this enough in the court or not .
In RCR, when can I put up my conditions.

if your evidence is true why to worry;
if she filled her statement then you can file your conditions or counter her statement after that.
do not object to her reply but raise the question
inform judge that “case is Pending”
“how can i take her back when she filed case ?”
“if she really wanted to come back why she filed the case …?
never say you dont want her.

I would like to know that in RCR, the judge told me to be present in the court & IPC 498a is pending. Is it safe to travel after obtaining AB or regular bail. The case is going on in Delhi.

if you have AB nothing to worry;
if its in different courts make it in one court on jurisdiction or some other reasons., that will be easier to contest.

Good Morning,
From the Date of RCR case upto 2 years, can judge ask me to be present in the court or not . Is it compulsory to be present for RCR case. How can I run RCR case without being present in the court.
In the last date of RCR, the judge has put case for mediation. Is it compulsory for me to be present for mediation or not . If I am not present for mediation then can the mediation be called off or next date will be given.

no need to be present always;
you have to be there when filling /mediation if any and for final
some court do not allow advocates in Family courts too.

Anticipatory bail = Getting Bail when you anticipating trouble in Advance. no need to have any case against you.
Regular Bail = Getting bail after you are in trouble.
In Simple words and Common man language.
AB = Wearing condom before you find a Girl full of AIDS.
RB = Wearing Condom after you got AIDS.

visit local self help groups
internet queries cannot solve everything
I see that dr D ‘ Souza is patiently replying a lot of your questions ….but you HAVE to meet people and learn the tricks of the LOCAL COURTS

Calling and explaining to Police or Govt / Public servents will not work.
you have to give it in writting. and post it by SPEED POST and keep recipt of post so anytime you can ask for the status with RTI.
if police is not listening, write to them explaining and she denied and you are innocent or your side of the story and request them to do proper investigation / enquiry or whatever…. and add a magic line below that letter
CC : Superitendent of Police and Your District name
If you are not sending another copy to SP, and nothing wrong sending copy to SP too.
then go and meet the police after few days. and see the difference.
