      Dear Sir,

      I was grilled u/s 498a without any fault of mine. My parents had to leave their house. I was driven away from my own house by my wife (I don’t like to term her my wife any more). She has ruined my life under the influence of her parents and brother (earlier he was bachellor, now married), her sister (who herself is a 498a woman and has married a young man without even getting divorce) and a policeman (who has been physical with her, a confession of whose is with me captured in a CD and for which I had even approached to Director General of Police of WB State without any response). This lady is residing in my own house with our son after driving me out in October 2007. She does not appear in the court on the dates of hearings of 498a etc. despite receiving summon in 2009. Instead she was a regular visitor during maintenance cases she had filed against me and the court gave decision in her favour for Rs.6000/- knowing well that I am homeless along with my parents (who are with my sister). Now she has again filed a Misc case for enhancement of monthly alimony.

      Please advice what to do. Please also mention the contact numbers of SIF, Kolkata.

      File dismiss/discharge petition under 239 crpc if its not dropped go to HC to quash it.

      If all the facts as mentioned by you are true & correct with evidence, you have to approach before the High Court of judicature for quashing proceeding & for staying civil proceeding.
