      The girl is not coming for the mutual consent second motion. Should I submit the petition for the summon for second motion in the lower court? It will get dismissed for sure and I assume that the girl will not be even summoned by the lower court. But this may help me, when I file for divorce in the higher court.

      Also the girl had deserted me and said she wants divorce when she came came to know that I had complained about her behaviour to the both sets of parents. Repeated attempts on mine & the parents part failed to change her mind. Will this desertion and the wordings of the first motion judgment help to deny her maintenance?

      whether u have filed divorce petition by mutual consent? if so after 6 months from date of filing it will be decided.

      If desertion coupled with cruelty then you can go for Divorce.

      Im sure she changed her mind to mutual and going for maintenance if you appeal for divorce.

      There are judgments wife who walk away from husband home without valid reason will not get Alimony.
