      Husband has been granted divorce by trial court. Wife filed appeal in High court against divorce & refrained husband from remarrying. Case pending in the high court for last two years without any progress. With such snail pace, it would take another 6-7 years to get final divorce from Apex court. By that time he may cross his reproductive period.

      1. Can husband go for a child from some surrogated mother through ART?

      2. Any legal advice?

      In India Surrogacy arrangement is possible and an understanding is arrived between the surrogate mother and the intended parents, where the surrogate mother carries a child which is genetically unrelated to her.

      but it is not permissible for single parent. if you are not legally divorced and your wife has not consented for the same you cannot even go for adoption leave aside surrogacy.

      as far as reproductive period is concerned, even a 99 years old man can produce a child

      You have to press through your lawyer for final hearing in HighCourt & it may be expediated, it depends upon your lawyer.

      Thanks everybody. One more query. If the huband goes for illegitimate child through some unmarried lady with her consent without marrying her, it will definetely amount to adultry, but will this adultry attract the provisions of bigammy? How will it affect the divorce case in High court? How the wife can proceed in this case i.e through police or through court?
