Application for Restitution of Conjugal Rights under 4 of 1869 of INDIAN DIVORCE ACT, 1869.

The aformentioned petitioner begs to state as under:-
That the applicant is the husband of the respondent, their marriage having been solemnized at Mapusa, Goa on

10/01/2009 according to the Christian religion rites.
That after the marriage, the petitioner and the respondent cohabited and resided together for about two years, In

india as well as in Kuwait, as petitioner was working there and during this period, the petitioner bear a Girl child.
When she was india, Petitioner sister found a job for her, as petitioner sister family was also in kuwait.
After respondent found job, and money she started to abuse and fight with petitioner for silly reasons, and was not

helping petitioner sister in house hold works as petitioner and his sister were sharing same house.
The petitioner and his relatives tried their best to convince the respondent and her parents but the respondent did

not improve her behavior.
Later in yearly holidays when petitioner and respondent came to india, Respondent asked petitioner to take her

matrimonial home to her father’s home for her brothers birthday.
As soon as petitioner reached respondent house, her family members started to abuse the petitioner as respondent

already sent many emails from kuwait falsly accusing petitioner.
As per Law, as long as respondent is married to petitioner she has no right to stay away from petitioner.

That the petitioner resides within the local limits of the jurisdiction of this Court, and hence, this hon’ble Court

has jurisdiction to try and decide this application.
That this application being chargeable with a fixed rate of Court fee, the same is paid herewith.
That the petitioner, therefore, prays that –
(a) This application be kindly allowed, and the responded to adivised to join petitioner
(b) The Costs of this application and expenditure of this case be awarded to the petitioner;
