{"id":2007,"date":"2011-01-05T09:37:53","date_gmt":"2011-01-05T04:07:53","guid":{"rendered":"http:\/\/mynation.net\/docs\/?p=2007"},"modified":"2011-01-05T09:37:53","modified_gmt":"2011-01-05T04:07:53","slug":"arbitration-act-1940","status":"publish","type":"post","link":"https:\/\/mynation.net\/docs\/arbitration-act-1940\/","title":{"rendered":"ARBITRATION ACT 1940"},"content":{"rendered":"<p>o Arbitration Act passed in 1940 and came into force on 1st July, 1940.<br \/>\no It extends to the whole of India except J&amp;K.<\/p>\n<p><strong>Meaning of Arbitration<br \/>\n<\/strong>The process of settling disputes between two parties, or their request through arbitrator is called Arbitration.<br \/>\nAccording to section \u2013 2(a) of Arbitration Act, 1940,\u0001 An Arbitration means a written agreement to submit present or future differences to arbitration whether arbitration is named or not.\u201d<\/p>\n<p>Essential Elements of Arbitration agreement Valid Arbitration agreement must contain the following elements:-<br \/>\ni. Must be in writing.<br \/>\nii. The disputes may be an existing one or it may arise in future, may be present for Arbitration.<br \/>\niii. It is not necessary to be signed on the arbitration agreement by the parties.<br \/>\niv. Must have all essentials of a valid contract.<br \/>\nv. Parties should have an agreement to settle the disputes through Arbitration.<\/p>\n<p><strong>Person who can refer to Arbitration<br \/>\n<\/strong>a) Agent duly authorised by employer.<br \/>\nb) Karta of joint HUF may refer any dispute relating to property of that family.<br \/>\nc) Official Assignee or Receiver with the leave of the court can refer dispute.<br \/>\nd) Attorney<br \/>\ne) Trustee, if authorised by the trust.<br \/>\nf) Company, if authorised by its MOA.<br \/>\ng) A partner only when he is authorised by other partners.<br \/>\nh) An insolvent cannot refer to dispute to arbitration so as to bind his estate.<\/p>\n<p><strong>Subject matter of Arbitration<br \/>\n<\/strong>I. All such matters relating to civil nature and affecting the personal or private rights of the parties.<br \/>\nII. Compoundable offences of criminal nature of disputes.<br \/>\nIII. Question of Facts as well as of Law.<br \/>\nIV. All disputes relating to Time barred claims.<br \/>\nV. Disputes relating to compliment, marriage, civil right and dignity.<br \/>\nVI. Question of determination of damages in case of Breach of Contract.<\/p>\n<p><strong>Matters which cannot be referred<br \/>\n<\/strong>1. Criminal nature<br \/>\n2. Matrimonial matters<br \/>\n3. Insolvency proceedings<br \/>\n4. Disputes relating to Public charities and Trust<br \/>\n5. Lunacy proceedings<br \/>\n6. Disputes relating Validity of Bill<br \/>\n7. Appointment of guardian of a Minor.<br \/>\n8. Illegal transaction<\/p>\n<p><strong>Modes of Submission to Arbitration<br \/>\n<\/strong>The provision of the act laid down the following modes for submitting the disputes to Arbitration.<br \/>\nA. Without Intervention of Court<br \/>\nB. With Intervention of Court<br \/>\nC. In Suits<\/p>\n<p><strong>Arbitrator<br \/>\n<\/strong>The person who may be appointed by the mutual consent of parties to settle the dispute is an Arbitrator.<br \/>\nAny person can be appointed as Arbitrator except the following:-<br \/>\n\u2022 A person who has direct interest in the subject matter of controversy.<br \/>\n\u2022 A person who is under any legal disability by virtue of statutory provision.<br \/>\n\u2022 Any person whose honesty is suspected<\/p>\n<p><strong>Appointment of Arbitrator<br \/>\n<\/strong>1) Appointment by Third Party<br \/>\n2) Appointment by Court<br \/>\n3) Appointment by Party<\/p>\n<p><strong>Rights of Arbitrator<br \/>\n<\/strong>Sec \u2013 13 of the Act provides the right to an arbitrator.<br \/>\n\u0001 To administer oath to parties to witnesses and parties appearing before him.<br \/>\n\u0001 To state a special case for the opinion of the court on any question of law or state the award in the form of a special case for the opinion of court.<br \/>\n\u0001 To make the award conditional or in alternative<br \/>\n\u0001 To rectify in an award any clerical mistake or error arising from any accidental slip or omission<br \/>\n\u0001 To administer any party interrogatories<br \/>\nSec \u2013 27 also give some powers to the arbitrator<br \/>\n\u0001 To make interim reward<br \/>\n\u0001 To award cost of reference and award of any party<br \/>\n\u0001 To order specific performance in certain cases<br \/>\n\u0001 To award interest<br \/>\n\u0001 Power to obtain legal assistance<br \/>\n\u0001 Power to delegate authority limited to the performance<\/p>\n","protected":false},"excerpt":{"rendered":"<p>o Arbitration Act passed in 1940 and came into force on 1st July, 1940. o It extends to the whole of India except J&amp;K.
