the\u00a0plaintiff&#8217;s\u00a0mother,\u00a0expired\u00a0on\u00a010th\u00a0 June,\u00a02013\u00a0leaving\u00a0behind\u00a0a\u00a0 registered \u00a0 will \u00a0 dated \u00a0 2nd\u00a0 July \u00a0 2011. \u00a0 The \u00a0 plaintiff \u00a0 has \u00a0 sought\u00a0 administration\u00a0of\u00a0her\u00a0estate.\u00a0\u00a0The\u00a0plaintiff\u00a0has\u00a0also\u00a0sought\u00a0disclosure\u00a0 of\u00a0the\u00a0remainder\u00a0of\u00a0the\u00a0estate\u00a0which\u00a0the\u00a0plaintiff\u00a0has\u00a0no\u00a0knowledge\u00a0 of. \u00a0 \u00a0 The \u00a0 plaintiff \u00a0 is \u00a0 the \u00a0 sole \u00a0 beneficiary \u00a0 under \u00a0 the \u00a0 will \u00a0 of \u00a0 the\u00a0 deceased\u00a0which\u00a0has\u00a0been\u00a0sought\u00a0to\u00a0be\u00a0probated.\u00a0\u00a0The\u00a0plaintiff\u00a0claims\u00a0 to\u00a0be\u00a0the\u00a0owner\u00a0of\u00a0the\u00a0properties\u00a0bequeathed\u00a0by\u00a0the\u00a0deceased\u00a0to\u00a0him\u00a0 and\u00a0the\u00a0usual\u00a0injunction\u00a0against\u00a0alienation\u00a0of\u00a0those\u00a0properties.<\/p>\n<p>2. \u00a0 In\u00a0 the\u00a0 suit\u00a0 the\u00a0 plaintiff\u00a0 has\u00a0 claimed\u00a0 partition\u00a0 of\u00a0immovable\u00a0 properties \u00a0 that \u00a0 have \u00a0 been \u00a0 bequeathed \u00a0 to \u00a0 him \u00a0 and \u00a0 mandatory\u00a0 injunction\u00a0directing\u00a0to\u00a0handover\u00a0those\u00a0properties\u00a0to\u00a0the\u00a0plaintiff\u00a0and\u00a0 the\u00a0usual\u00a0permanent\u00a0injunctions\u00a0against\u00a0alienation.<\/p>\n<p>3. \u00a0 The\u00a0defendant\u00a0has\u00a0filed\u00a0his\u00a0affidavit\u00adin\u00adreply\u00a0to\u00a0the\u00a0notice\u00a0of\u00a0 motion\u00a0to\u00a0oppose\u00a0the\u00a0grant\u00a0of\u00a0ad\u00adinterim\u00a0reliefs.\u00a0\u00a0The\u00a0plaintiff\u00a0has\u00a0 filed\u00a0the\u00a0rejoinder\u00a0thereto.<\/p>\n<p>4. \u00a0 For\u00a0considering\u00a0the\u00a0properties\u00a0which\u00a0constituted\u00a0the\u00a0estate\u00a0of\u00a0 the\u00a0deceased\u00a0the\u00a0cases\u00a0of\u00a0the\u00a0respective\u00a0parties\u00a0are\u00a0required\u00a0to\u00a0be\u00a0 seen\u00a0for\u00a0the\u00a0grant\u00a0of\u00a0the\u00a0injunctive\u00a0reliefs\u00a0claimed.\u00a0\u00a0The\u00a0plaintiff\u00a0has\u00a0 set\u00a0out\u00a0the\u00a0properties\u00a0comprising\u00a0the\u00a0estate\u00a0of\u00a0the\u00a0deceased\u00a0in\u00a0the\u00a0 list \u00a0 of \u00a0 immovable \u00a0 properties \u00a0Exhibit\u00adC\u00a0 and \u00a0 the \u00a0 list \u00a0 of \u00a0 movable\u00a0 properties,\u00a0 \u00a0Exhibit\u00adD\u00a0 to\u00a0 the\u00a0plaint.\u00a0 \u00a0For\u00a0 the\u00a0purpose\u00a0of\u00a0notice\u00a0of\u00a0 motion,\u00a0a\u00a0consideration\u00a0of\u00a0the\u00a0immovable\u00a0properties\u00a0is\u00a0required.<\/p>\n<p>5. \u00a0 Mumbai\u00ad400\u00a0022.\u00a0\u00a0The\u00a0defendant\u00a0resides\u00a0in\u00a0that\u00a0flat.\u00a0\u00a0The\u00a0plaintiff\u00a0 had\u00a0left\u00a0 that\u00a0 premises\u00a0 upon\u00a0 certain\u00a0 disputes\u00a0 between\u00a0 the\u00a0 parties\u00a0 prior\u00a0to\u00a0the\u00a0death\u00a0of\u00a0the\u00a0deceased.\u00a0\u00a0In\u00a0the\u00a0notice\u00a0of\u00a0motion\u00a0the\u00a0usual\u00a0 injunctions \u00a0 against \u00a0 sale \u00a0 and \u00a0 alienation \u00a0 of \u00a0 that \u00a0 property \u00a0 would\u00a0 suffice.<\/p>\n<p>6. \u00a0 The\u00a0plaintiff\u00a0also\u00a0claims\u00a0tenancy\u00a0rights\u00a0in\u00a0the\u00a0garage\u00a0No.1\u00a0in\u00a0 Urvashi\u00a0Building,\u00a0Sion(West),\u00a0Mumbai\u00ad400\u00a0022.\u00a0\u00a0It\u00a0is\u00a0stated\u00a0to\u00a0be\u00a0a\u00a0 parking\u00a0garage.\u00a0\u00a0It\u00a0is\u00a0contended\u00a0that\u00a0it\u00a0is\u00a0neither\u00a0a\u00a0residential\u00a0nor\u00a0a\u00a0 commercial\u00a0premises.\u00a0\u00a0It\u00a0is\u00a0not\u00a0covered\u00a0under\u00a0Section\u00a05(11)\u00a0(c\u00a0)\u00a0(i)\u00a0 or\u00a0(ii)\u00a0of\u00a0 the\u00a0Bombay\u00a0Rent\u00a0Act,\u00a01947\u00a0or\u00a0Section\u00a07(15)(d)\u00a0of\u00a0 the\u00a0 Maharashtra\u00a0Rent\u00a0Control\u00a0Act,\u00a01999.\u00a0\u00a0It\u00a0would\u00a0have\u00a0to\u00a0be\u00a0seen\u00a0in\u00a0 the\u00a0suit\u00a0whether\u00a0a\u00a0garage\u00a0would\u00a0devolve\u00a0upon\u00a0any\u00a0member\u00a0of\u00a0the\u00a0 family\u00a0of\u00a0the\u00a0deceased\u00a0upon\u00a0the\u00a0death\u00a0of\u00a0the\u00a0tenant\u00a0as\u00a0a\u00a0statutory\u00a0 tenant\u00a0 cannot\u00a0 bequeath\u00a0 the\u00a0 tenancy\u00a0 right\u00a0 as\u00a0 held\u00a0in\u00a0 the\u00a0 case\u00a0 of\u00a0 Vasant\u00a0Pratap\u00a0Pandit\u00a0Vs.\u00a0Dr.\u00a0Anant\u00a0Trimbak\u00a0Sabnis\u00a01994\u00a0Mh.L.J.\u00a0 1450; \u00a0However \u00a0 that \u00a0 judgment \u00a0 considered \u00a0 a \u00a0 commercial \u00a0 or \u00a0 a\u00a0 residential \u00a0 premises. \u00a0 \u00a0 A \u00a0 parking \u00a0 garage \u00a0 in \u00a0 which \u00a0 user \u00a0 and\u00a0 occupation\u00a0was\u00a0only\u00a0parking\u00a0vehicles\u00a0would\u00a0not\u00a0be\u00a0on\u00a0par\u00a0with\u00a0a\u00a0 residential\u00a0or\u00a0commercial\u00a0premises\u00a0in\u00a0which\u00a0some\u00a0of\u00a0the\u00a0heirs\u00a0of\u00a0the\u00a0 deceased\u00a0live\u00a0or\u00a0carry\u00a0on\u00a0business\u00a0along\u00a0with\u00a0the\u00a0deceased\u00a0during\u00a0 the\u00a0life\u00a0time\u00a0of\u00a0the\u00a0deceased.\u00a0 \u00a0The\u00a0garage\u00a0may\u00a0revert\u00a0back\u00a0to\u00a0the\u00a0 owner\u00a0upon\u00a0the\u00a0death\u00a0of\u00a0the\u00a0tenant\u00a0or\u00a0may\u00a0devolve\u00a0upon\u00a0the\u00a0heirs\u00a0 in\u00a0equal\u00a0shares.\u00a0\u00a0Upon\u00a0such\u00a0consideration\u00a0of\u00a0the\u00a0law\u00a0the\u00a0title\u00a0which\u00a0 may\u00a0pass\u00a0upon\u00a0the\u00a0bequest\u00a0would\u00a0be\u00a0considered.\u00a0\u00a0Pending\u00a0that\u00a0the\u00a0 garage\u00a0must\u00a0be\u00a0protected\u00a0against\u00a0alienation\u00a0and\u00a0sale.<\/p>\n<p>7. \u00a0 The\u00a0 plaintiff\u00a0 has\u00a0made\u00a0 an\u00a0 unusual\u00a0 claim \u00a0 upon\u00a0 an\u00a0 unusual\u00a0 bequest\u00a0under\u00a0the\u00a0will\u00a0of\u00a0the\u00a0deceased.\u00a0\u00a0The\u00a0will,\u00a0Exhibit\u00adB\u00a0 to\u00a0the\u00a0 plaint,\u00a0 shows\u00a0inter\u00a0 alia\u00a0 as\u00a0 one\u00a0 of\u00a0 the\u00a0 properties\u00a0 of\u00a0 the\u00a0 deceased\u00a0 whatever \u00a0 \u201cmonies\u201d \u00a0 that \u00a0 come \u00a0 to \u00a0 \u201cmy \u00a0 share\u201d \u00a0 in \u00a0 the \u00a0 account \u00a0 of\u00a0 Narendra\u00a0Amrutlal\u00a0Shah\u00a0(NAS)\u00a0HUF\u00a0which\u00a0includes\u00a01\/3\u00a0 share\u00a0of\u00a0 NAS\u00a0HUF\u00a0in\u00a0a\u00a0bungalow\u00a0situate\u00a0at\u00a0Ashwamegh\u00a0Co\u00adop.\u00a0Hsng.\u00a0Society\u00a0 in\u00a0Ahmadabad.\u00a0 \u00a0The\u00a0 title\u00a0 of\u00a0 the\u00a0 deceased\u00a0 to\u00a0 give\u00a0 her\u00a0 a\u00a0 right\u00a0 to\u00a0 bequeath\u00a0 the\u00a0property\u00a0would\u00a0have\u00a0 to\u00a0be\u00a0 seen\u00a0in\u00a0 the\u00a0monies\u00a0 that\u00a0 would\u00a0come\u00a0to\u00a0her\u00a0share\u00a0in\u00a0a\u00a0HUF\u00a0of\u00a0her\u00a0husband,\u00a0the\u00a0defendant\u00a0 herein.\u00a0\u00a0The\u00a0husband\u00a0was\u00a0alive\u00a0on\u00a0the\u00a0date\u00a0of\u00a0the\u00a0will\u00a0as\u00a0also\u00a0on\u00a0the\u00a0 date\u00a0of\u00a0her\u00a0death.\u00a0\u00a0The\u00a0deceased\u00a0was\u00a0not\u00a0a\u00a0widow.\u00a0\u00a0The\u00a0deceased\u00a0 did\u00a0not\u00a0get\u00a0the\u00a0share\u00a0which\u00a0belonged\u00a0to\u00a0her\u00a0husband\u00a0in\u00a0 the\u00a0HUF\u00a0 upon\u00a0her\u00a0husband&#8217;s\u00a0death\u00a0as\u00a0per\u00a0Section\u00a03\u00a0of\u00a0the\u00a0Hindu\u00a0Women&#8217;s\u00a0 Right\u00a0to\u00a0Property\u00a0Act,\u00a01937.\u00a0\u00a0The\u00a0deceased\u00a0was\u00a0not\u00a0a\u00a0member\u00a0of\u00a0any\u00a0 HUF\u00a0which\u00a0owned\u00a0a\u00a0bungalow\u00a0in\u00a0which\u00a0her\u00a0husband,\u00a0the\u00a0defendant\u00a0 herein,\u00a0 had\u00a0 a\u00a0 1\/3\u00a0 share.\u00a0 \u00a0 It\u00a0is\u00a0 argued\u00a0 that\u00a0 the\u00a0 deceased\u00a0was\u00a0 a\u00a0 member\u00a0 of\u00a0 the\u00a0joint\u00a0 family\u00a0of\u00a0her\u00a0 husband\u00a0 along\u00a0with\u00a0her\u00a0 three\u00a0 children,\u00a0the\u00a0plaintiff\u00a0being\u00a0one\u00a0of\u00a0\u00a0them\u00a0and\u00a0the\u00a0other\u00a0two\u00a0being\u00a0his\u00a0 step\u00a0brothers.\u00a0\u00a0It\u00a0is,\u00a0therefore,\u00a0argued\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0plaintiff\u00a0that\u00a0 the\u00a0deceased\u00a0had\u00a0a\u00a01\/5\u00a0share\u00a0in\u00a0the\u00a01\/3\u00a0share\u00a0which\u00a0her\u00a0husband\u00a0 had\u00a0in\u00a0 the\u00a0HUF\u00a0which\u00a0 owned\u00a0 a\u00a0 bungalow.\u00a0 \u00a0Hence\u00a0 the\u00a0 deceased\u00a0 would\u00a0claim\u00a0to\u00a0be\u00a0entitled\u00a0to\u00a0a\u00a020%\u00a0share\u00a0of\u00a0the\u00a0HUF\u00a0properties.<\/p>\n<p>8. \u00a0 The\u00a0deceased\u00a0was\u00a0the\u00a0wife\u00a0of\u00a0the\u00a0defendant.\u00a0\u00a0She\u00a0was\u00a0not\u00a0a\u00a0 member\u00a0of\u00a0his\u00a0joint\u00a0Hindu\u00a0family\u00a0except\u00a0as\u00a0his\u00a0wife.\u00a0\u00a0It\u00a0is\u00a0only\u00a0when\u00a0 the \u00a0 defendant \u00a0 would \u00a0 constitute \u00a0 HUF \u00a0 for \u00a0 the \u00a0 purpose \u00a0 of \u00a0 his\u00a0 succession\u00a0that\u00a0his\u00a0wife\u00a0may\u00a0be\u00a0shown\u00a0as\u00a0the\u00a0member\u00a0of\u00a0the\u00a0HUF.\u00a0 The\u00a0wife\u00a0of\u00a0a\u00a0Hindu\u00a0Coparcener\u00a0in\u00a0a\u00a0HUF\u00a0is\u00a0not\u00a0a\u00a0Coparcener.\u00a0She\u00a0 does\u00a0not\u00a0get\u00a0any\u00a0interest\u00a0by\u00a0virtue\u00a0of\u00a0her\u00a0birth\u00a0in\u00a0her\u00a0marital\u00a0family.\u00a0 Only\u00a0 a\u00a0person\u00a0who\u00a0would\u00a0derive\u00a0 an\u00a0interest\u00a0by\u00a0virtue\u00a0of\u00a0his\/her\u00a0 birth\u00a0in\u00a0a\u00a0family\u00a0would\u00a0become\u00a0a\u00a0Coparcener,\u00a0a\u00a0Coparcenery\u00a0being\u00a0a\u00a0 much\u00a0narrower\u00a0body\u00a0than\u00a0a\u00a0Hindu\u00a0Joint\u00a0Family.<\/p>\n<p>9. \u00a0\u00a0 Counsel\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0defendant\u00a0has\u00a0also\u00a0produced\u00a0the\u00a0Law\u00a0 Lexicon\u00a0\u00a0page\u00a0416\u00a0showing\u00a0the\u00a0definition\u00a0of\u00a0coparceners\u00a0thus\u00a0:\u00a0 \u201cCoparceners.\u00a0 Otherwise \u00a0 called \u00a0 Parceners, \u00a0 are \u00a0 such \u00a0 as\u00a0 have\u00a0equal\u00a0portion\u00a0in\u00a0 the\u00a0inheritance\u00a0of\u00a0an\u00a0ancestor,\u00a0or\u00a0 who\u00a0come\u00a0in\u00a0equality\u00a0to\u00a0the\u00a0lands\u00a0of\u00a0their\u00a0ancestors. Coparcener.\u00a0 \u00a0 One\u00a0 who\u00a0 shares\u00a0 (equally)\u00a0 with\u00a0 others\u00a0in\u00a0 inheritance \u00a0in \u00a0 the \u00a0 estate \u00a0 of \u00a0 a \u00a0 common \u00a0 ancestor \u00a0 [S. \u00a0 6,\u00a0 expln.\u00a01,\u00a0Hindu\u00a0Succession\u00a0Act]\u201d.\u00a0 It\u00a0further\u00a0shows\u00a0coparcenery\u00a0property\u00a0thus:\u00a0\u00a0 Coparcenary \u00a0 property.\u00a0 The \u00a0 expression \u00a0 &#8216;Coparcenary \u00a0 property&#8217;\u00a0includes\u00a0property\u00a0in\u00a0which\u00a0the\u00a0deceased\u00a0husband \u00a0 had\u00a0an\u00a0interest\u00a0as\u00a0a\u00a0joint\u00a0owner\u00a0during\u00a0his\u00a0life\u00a0time\u00a0and,\u00a0 therefore,\u00a0ancestral\u00a0property. which\u00a0he\u00a0is\u00a0a\u00a0coparcerner,\u00a0the\u00a0husband\u00a0would\u00a0have\u00a0got\u00a0a\u00a0share\u00a0in\u00a0 that \u00a0 partition. \u00a0 \u00a0 That \u00a0 would \u00a0 have \u00a0 been \u00a0 ancestral \u00a0 property \u00a0 in \u00a0 his\u00a0 hands.\u00a0\u00a0That\u00a0would\u00a0have,\u00a0therefore,\u00a0been\u00a0his\u00a0HUF\u00a0property.\u00a0\u00a0In\u00a0that\u00a0 property\u00a0 the\u00a0 deceased\u00a0who\u00a0was\u00a0 a\u00a0member\u00a0of\u00a0her\u00a0 husband&#8217;s\u00a0 (the\u00a0 defendant&#8217;s)\u00a0HUF\u00a0would\u00a0have\u00a0had\u00a0a\u00a0share.\u00a0\u00a0The\u00a0deceased\u00a0could\u00a0not\u00a0 have\u00a0demanded\u00a0a\u00a0partition.\u00a0 \u00a0Had\u00a0there\u00a0been\u00a0a\u00a0partition\u00a0upon\u00a0the\u00a0 demand\u00a0of\u00a0the\u00a0coparceners\u00a0(the\u00a0husband\u00a0and\u00a0children),\u00a0she\u00a0would\u00a0 have\u00a0 got \u00a0 a \u00a0 share \u00a0 thereunder.\u00a0 \u00a0 That \u00a0 share \u00a0 would \u00a0 have\u00a0 been \u00a0 her\u00a0 separate\u00a0property\u00a0bequeathable\u00a0by\u00a0her.\u00a0 \u00a0She\u00a0expired\u00a0prior\u00a0to\u00a0such\u00a0 share\u00a0being\u00a0obtained.\u00a0\u00a0Since\u00a0her\u00a0husband\u00a0did\u00a0not\u00a0expire,\u00a0she\u00a0would\u00a0 not\u00a0have\u00a0the\u00a0rights\u00a0of\u00a0a\u00a0widow\u00a0also.\u00a0\u00a0Consequently\u00a0she\u00a0had\u00a0no\u00a0share\u00a0 and\u00a0no\u00a0bequeathable\u00a0interest\u00a0in\u00a0any\u00a0share\u00a0which\u00a0devolved\u00a0upon\u00a0her\u00a0 without\u00a0conferring\u00a0upon\u00a0her\u00a0the\u00a0status\u00a0of\u00a0coparcener\u00a0or\u00a0the\u00a0right\u00a0to\u00a0 represent\u00a0other\u00a0members\u00a0of\u00a0the\u00a0family\u00a0as\u00a0a\u00a0Karta\u00a0of\u00a0an\u00a0HUF.<\/p>\n<p>18.\u00a0 The \u00a0 right \u00a0 under \u00a0 Section \u00a0 3 \u00a0 is, \u00a0 therefore, \u00a0 available \u00a0 only \u00a0 to\u00a0 widows.\u00a0\u00a0It\u00a0is\u00a0a\u00a0limited\u00a0right.\u00a0\u00a0It\u00a0is\u00a0a\u00a0right\u00a0in\u00a0the\u00a0share\u00a0which\u00a0the\u00a0 husband\u00a0had\u00a0in\u00a0 the\u00a0coparcenary.\u00a0 \u00a0Section\u00a03\u00a0has\u00a0been\u00a0repealed\u00a0by\u00a0 Section\u00a014\u00a0of\u00a0the\u00a0Hindu\u00a0Succession\u00a0Act,\u00a01956\u00a0which\u00a0gives\u00a0the\u00a0right\u00a0 to\u00a0a\u00a0Hindu\u00a0woman\u00a0in\u00a0lieu\u00a0of\u00a0her\u00a0possession\u00a0 therein.\u00a0 \u00a0That\u00a0is\u00a0an\u00a0 entirely\u00a0different\u00a0concept.<\/p>\n<p>19.\u00a0 The\u00a0claim\u00a0by\u00a0a\u00a0wife\u00a0during\u00a0the\u00a0life\u00a0time\u00a0of\u00a0the\u00a0husband\u00a0in\u00a0the\u00a0 share\u00a0and\u00a0interest\u00a0which\u00a0he\u00a0has\u00a0as\u00a0a\u00a0coparcener\u00a0in\u00a0his\u00a0HUF\u00a0is\u00a0wholly\u00a0 premature\u00a0and\u00a0completely\u00a0misconceived.\u00a0 \u00a0Such\u00a0bequest\u00a0under\u00a0the\u00a0 will\u00a0does\u00a0not\u00a0show\u00a0the\u00a0title\u00a0of\u00a0the\u00a0deceased\u00a0to\u00a0such\u00a0property.\u00a0\u00a0The\u00a0 deceased,\u00a0 therefore,\u00a0 could\u00a0 not\u00a0 have\u00a0 bequeathed\u00a0 any\u00a0 \u201cmonies\u201d\u00a0 as\u00a0 \u201cmy\u00a0share\u201d\u00a0in\u00a0the\u00a01\/3\u00a0share\u00a0which\u00a0her\u00a0husband\u00a0had\u00a0in\u00a0the\u00a0HUF\u00a0in\u00a0 which\u00a0he\u00a0was\u00a0a\u00a0coparcener\u00a0along\u00a0with\u00a0his\u00a0brothers,\u00a0father\u00a0and\u00a0sons.\u00a0 Consequently\u00a0the\u00a0injunction\u00a0in\u00a0respect\u00a0of\u00a0such\u00a0property\u00a0cannot\u00a0be\u00a0 granted\u00a0as\u00a0claimed.<\/p>\n<p>20.\u00a0 The\u00a0 other\u00a0movable\u00a0estate\u00a0 of\u00a0 the\u00a0 deceased\u00a0 are\u00a0 shown\u00a0 to\u00a0 be\u00a0 certain\u00a0articles\u00a0and\u00a0jewellery,\u00a0furniture\u00a0&amp;\u00a0fixtures\u00a0and\u00a0shares\u00a0in\u00a0three\u00a0 private\u00a0family\u00a0companies.\u00a0\u00a0It\u00a0would\u00a0be\u00a0for\u00a0the\u00a0plaintiff\u00a0to\u00a0prove\u00a0the\u00a0 properties\u00a0claimed\u00a0by\u00a0the\u00a0plaintiff\u00a0since\u00a0it\u00a0is\u00a0disputed.\u00a0\u00a0 21.\u00a0 The\u00a0private\u00a0limited\u00a0companies\u00a0shown\u00a0by\u00a0the\u00a0plaintiff\u00a0in\u00a0which\u00a0 the\u00a0 deceased\u00a0 had\u00a0 certain\u00a0equity\u00a0 shares\u00a0 are\u00a0 stated\u00a0 to\u00a0 be\u00a0 defunct.\u00a0 What\u00a0was\u00a0the\u00a0worth\u00a0of\u00a0those\u00a0companies\u00a0and\u00a0the\u00a0shares\u00a0since\u00a0would\u00a0 have\u00a0to\u00a0be\u00a0ascertained\u00a0at\u00a0the\u00a0trial.\u00a0\u00a0Such\u00a0estate\u00a0of\u00a0the\u00a0deceased\u00a0is\u00a0 not\u00a0disputed.<\/p>\n<p>22.\u00a0 Hence\u00a0the\u00a0following\u00a0order:<\/p>\n<p>1. \u00a0 The \u00a0 defendant \u00a0 shall \u00a0 not \u00a0 alienate, \u00a0 encumber,\u00a0 transfer,\u00a0 part\u00a0with\u00a0 possession\u00a0 or\u00a0 otherwise\u00a0 create\u00a0 any\u00a0 third\u00a0party\u00a0rights\u00a0in\u00a0flat\u00a0No.14,\u00a0Premkunj\u00a0Co\u00adop.\u00a0Hsng,\u00a0 1\/5\u00a0share\u00a0of\u00a0the\u00a0deceased\u00a0as\u00a0a\u00a0coparcener\u00a0in\u00a0Narendra\u00a0 Amritlal \u00a0 Shah \u00a0 HUF \u00a0 or \u00a0 in \u00a0 the \u00a0 land \u00a0 or \u00a0 bungalow \u00a0 at\u00a0 Ahmedabad.<\/p>\n<p>3. \u00a0 There\u00a0shall\u00a0be\u00a0no\u00a0order\u00a0with\u00a0regard\u00a0to\u00a0the\u00a0articles\u00a0 of\u00a0jewellery\u00a0or\u00a0furniture\u00a0&amp;\u00a0fixtures\u00a0of\u00a0the\u00a0deceased.<\/p>\n<p>4. \u00a0 The\u00a0defendant\u00a0 shall\u00a0not\u00a0alienate,\u00a0encumber,\u00a0part\u00a0 with\u00a0possession\u00a0or\u00a0create\u00a0any\u00a0 third\u00a0party\u00a0rights\u00a0in\u00a0 the\u00a0 equity\u00a0shares\u00a0held\u00a0by\u00a0the\u00a0deceased\u00a0in\u00a0the\u00a0three\u00a0private\u00a0
