…. for the State
It is submitted by the learned Counsel appearing for the
petitioner that he is the brother-in-law of the victim housewife and
resided separately from the home where the couple resided. Co-
accused person Goutam Kumar Biswas has been granted pre-arrest
bail.
Learned Counsel appearing for the State submits that the victim
housewife suffered unnatural death within one year after her marriage.
Having considered the materials in the case diary and bearing in
mind the fact that the petitioner did not reside with the couple at the
matrimonial home and the extent of complicity of the petitioner in the
alleged crime, we are of the opinion that petitioner may be granted
anticipatory bail in the instant case.
Accordingly, we direct that in the event of arrest the petitioner shall
be released on bail upon furnishing a bond of Rs.10,000/-, with two
2
sureties of like amount, to the satisfaction of the arresting officer and
also subject to the conditions as laid down under Section 438(2) of the
Code of Criminal Procedure, 1973.
This application for anticipatory bail is, thus, disposed of.
