In Re: Beuti Das alias Beauty Das Ors. ……… petitioners
Ms. Minoti Gomes
…for the petitioners
Mr. S. G. Mukherjee, learned P.P.,
Mr. Aniket Mitra
… for the State
It is submitted by the learned Counsel appearing for the petitioners that they are married sisters-
in-law of the victim housewife and did not reside at the matrimonial home of the victim.
Learned Counsel appearing for the State opposes the prayer for anticipatory bail.
We have considered the materials on record. Allegations against
the petitioners are general and omnibus in nature. Having considered
the materials on record in the light of the aforesaid submission made on
behalf of the petitioners that they did not ordinarily reside at the
matrimonial home of the victim, we are inclined to grant anticipatory
bail to the petitioners.
Accordingly, we direct that in the event of arrest the petitioners
shall be released on bail upon furnishing a bond of Rs.10,000/- each,
with two sureties of like amount each, to the satisfaction of the
arresting officer and also subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure, 1973 on condition
2
that the petitioners shall appear before the court below and pray for
regular bail within a period of four weeks from date.
This application for anticipatory bail is, thus, allowed.
