In Re:- An application for bail under Section 439 of the Code of
Criminal Procedure filed on 02.08.2019 in connection with Pandua
Police Station Case No. 262 of 2017 dated 10.05.2017 under Sections
498A/Section302 of the Indian Penal Code.

And

In Re : Indrajit Hira alias Indra …… petitioner

It is submitted by the learned Counsel appearing for the petitioner

that he is the maternal uncle-in-law of the housewife and is in custody

for 46 days. Co-accused persons are on bail.

Learned Counsel appearing for the State opposes the prayer for

bail.

Having considered the materials on record and bearing in mind

the extent of complicity of the petitioner in the alleged crime and as the

co-accused persons, similarly circumstanced with the petitioner, have

been granted bail, we are inclined to extend the same privilege to the

petitioner also.

Accordingly we direct that the petitioner shall be released on bail

upon furnishing a bond of Rs.10,000/- with two sureties of like amount

each, one of whom must be local, to the satisfaction of the learned Chief

Judicial Magistrate, Hooghly, subject to condition that he shall appear

before the trial court on every date of hearing until further orders and

shall not intimidate the witnesses and/or tamper with evidence in any

manner whatsoever.

In the event of violation of any of the conditions, the trial court

shall be at liberty to cancel his bail without further reference to this

Court.

The application for bail is, accordingly, allowed.
