In Re : Nilam Mondal Anr. …… petitioners

Mr. M. H. Chowdhury
Ms. D. Ray Sarkar
…… for the petitioners
Mr. S. S. Imam
Mr. A. Manna
…… for the State

Heard the learned advocates appearing for the respective
parties.

It is submitted on behalf of the petitioners that the co-
accused Bapan Mondal has been granted anticipatory bail.
Victim died due to accidental poising.

Learned lawyer for the State opposes the prayer for
anticipatory bail.

Having considered the materials in the case diary and
bearing in mind the extent of complicity of the petitioners i.e. the
in-laws of the victim housewife in the alleged crime and in the
light of the submission made on behalf of the petitioners, we are
inclined to grant anticipatory bail to the petitioners.

Accordingly, we direct that in the event of arrest, the
petitioners shall be released on bail upon furnishing a bond of
Rs. 10,000/- each with two sureties of like amount, to the
satisfaction of the Arresting Officer and also be subject to the
conditions as laid down under Sectionsection 438(2) of the Code of
Criminal Procedure, 1973 and that the petitioners shall appear
2

before the court below and pray for regular bail within four weeks
form date.

The application being CRM 8139 of 2019 is disposed of.
