Heard the learned advocates appearing for the respective

parties.

Report is placed on record.

Having considered the materials on record and bearing in

mind the extent of complicity of the petitioner in the alleged crime

in the light of the submission that the incident occurred 11 years

after marriage, we are inclined to grant anticipatory bail to the

petitioner.

Accordingly, we direct that in the event of arrest, the

petitioner shall be released on bail upon furnishing a bond of Rs.

10,000/- with two sureties of like amount each, to the

satisfaction of the Arresting Officer and also be subject to the

conditions as laid down under section 438(2) of the Code of

Criminal Procedure, 1973.

Petitioner shall appear before the investigating officer and

hand over passport, if any, within four weeks from date. In the

event he does not have passport, he shall personally appear

before the investigating officer and furnish affidavit to that effect

within the time frame mentioned hereinabove.

The application being CRM 1893 of 2020 is disposed of.
