The petitioners seek bail in connection Khandaghosh Police Station

Case No.243 of 2018 dated 17.12.2018 under Sections 498A/306/34 of the

Indian Penal Code.

The petitioners are the husband and the parents-in-law of the victim

whose body was discovered from a water-body barely 100 metre from the

matrimonial home about ten years after her marriage.

The State refers to the post-mortem report which indicates certain

observations of minor ante-mortem injuries and pens the cause of death to

ante-mortem drowning.

The State also refers to the statements of some of the neighbours of

an altercation the day before the victim went missing on December 12,

2018 before her body was found a day later. The principal charge levelled is

of abetting suicide. In the circumstances, there is no question of further

detention of the petitioners who have remained in custody close to three

months.

The petitioners will be released on bail upon furnishing a bond of

Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like

amount, to the satisfaction of the Chief Judicial Magistrate, Purba

Bardhaman on the conditions that the petitioners will not intimidate any

witness or tamper with any evidence in any manner whatsoever and the

petitioner will be obliged to attend Court on the dates fixed for the trial.

In the event the petitioners violate any of the conditions indicated

above, the trial court will be at liberty to cancel the bail without reference to

this Court.

The prayer for bail is allowed, subject to the conditions stated above.

Certified photocopies of this order, if applied for, be supplied to the

parties upon compliance with all requisite formalities.
