And
In Re: Susmita Biswas Ors.
… … Petitioners.
Mr. Amanul Islam,
Mr. Sourav Mukherjee
… for the petitioners.
Mr. Sudip Ghosh,
Mr. Apurba Kumar Dutta
… … for the State.
Having considered the materials on record and keeping in
mind the extent of complicity of the petitioners i.e. in-laws of the
victim/housewife in the alleged crime and as the principal accused
i.e. husband had already been arrested and as the incident occurred
15 years after marriage, we are inclined to grant anticipatory bail to
the petitioners.
Accordingly, we direct that in the event of arrest, the
petitioners be released on bail upon furnishing a bond of
Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of
like amount each, to the satisfaction of the arresting officer and also
be subject to the conditions as laid down under Section 438(2) of the
Code of Criminal Procedure, 1973. Petitioners shall appear before
the investigating officer and hand over their passports, if any, within
a period of four weeks from date. In the event the petitioners do not
have passports, they shall personally appear before the investigating
2
officer and furnish affidavits to that effect within the time frame
mentioned herein above.
The application for anticipatory bail is, thus, disposed of.
