Heard the learned advocates appearing for the respective
Petitioners are in custody for 329 days and it is submitted on
behalf of the petitioner that there is slow progress of trial since the
last rejection of bail by this court.
Learned lawyer for the State opposes the prayer for bail and
submits that date for recording of prosecution evidence has been
fixed before the trial court.
Having considered the materials in the case diary and bearing
in mind the prima facie involvement of the petitioner in the alleged
murder and the fact that trial has progressed since the last
rejection of bail by this court, we are of the opinion that this is not a
fit case to grant bail to the petitioner at this stage.
Accordingly, the prayer for bail is rejected.
However, trial court is directed to expedite the trial and
conclude the same at an early date without granting unnecessary
adjournments to either of the parties.
