In Re : Smt. Sabita Hazra …… petitioner

Mr. D Maiti
…… for the petitioner
Mr. S Kumar
…… for the State

Heard the learned advocates appearing for the respective
parties.

Having considered the materials on record and bearing in
mind the extent of complicity of the petitioner i.e mother in law of
the victim housewife in the alleged crime and as the principal
accused i.e husband is released on bail, we are inclined to grant
anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the
petitioner shall be released on bail upon furnishing a bond of Rs.
10,000/- with two sureties of like amount each, to the
satisfaction of the Arresting Officer and also be subject to the
conditions as laid down under section 438(2) of the Code of
Criminal Procedure, 1973.

Petitioner shall appear before the court below and hand
over passport, if any, within four weeks from date. In the event
she does not have passport, she shall personally appear before
the investigating officer and furnish affidavit to that effect within
the time frame mentioned hereinabove.

The application being CRM 2487 of 2020 is disposed of.
