It is submitted by the learned counsel for the petitioners that the husband
of the victim has surrendered and still in custody.
We have perused the case diary which reveals only injury on scalp and the
complicity against husband.
We, however, do not find any complicity against the present petitioners
who are father-in-law and mother-in-law of the victim and we do not find any
justification of their custodial interrogation.
Accordingly, we direct that in the event of arrest, the petitioners shall be
released on bail upon furnishing a bond of Rs.5,000/- (Rupees five thousand
only), with two sureties of like amount each, to the satisfaction of the arresting
officer and also be subject to the conditions as laid down under Section 438(2) of
the Code of Criminal Procedure, 1973 and on condition that the petitioners shall
2
appear before the court below and pray for regular bail within a period of four
weeks from date.
The application for anticipatory bail is, thus, disposed of.
