In Re : Rafikul Rahaman …… petitioner

Mr. Sudip Guha
…… for the petitioner
Mr. Arijit Ganguly
Mr. Avik Ghatak
…… for the State

Heard the learned advocates appearing for the respective

parties.

It is submitted on behalf of the petitioner that the co-accused

persons have been granted anticipatory bail.

Learned lawyer for the State opposes the prayer for
anticipatory bail and submits that the petitioner is the husband of
the victim housewife who was severely beaten by him.

Having considered materials in the case diary and bearing in
mind the predominant role played by the petitioner in assaulting
his wife which is supported by medical evidence and that he does
not stand on the same footing with the co-accused persons who
have been granted anticipatory bail, we are of the opinion that this
is not a fit case to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail is rejected.
