And
In Re: Sabbir Ahamad @ Sabir Ahamed
… … Petitioner.

Mr. Tapodip Gupta
… for the petitioner.

Mr. I. Ali,
Mr. M.F.A. Begg
… … for the State.

Having considered the materials on record and bearing in

mind the nature of allegations and as the allegation of physical

assault is not supported by medical evidence, we are inclined to

grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the

petitioner be released on bail upon furnishing a bond of

Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like

amount each, to the satisfaction of the arresting officer and also be

subject to the conditions as laid down under Section 438(2) of the

Code of Criminal Procedure, 1973 and on further condition that the

petitioner shall meet the investigating officer once in a week until

further orders. Petitioner shall appear before the investigating

officer and hand over his passport, if any, within a fortnight from

date. In the event the petitioner does not have a passport, he shall

personally appear before the investigating officer and furnish an
2

affidavit to that effect within the time frame mentioned herein

above.

The application for anticipatory bail is, thus, disposed of.
