In Re : An application for anticipatory bail under Sectionsection 438 of the
Code of Criminal Procedure filed on 23.7.2019 in connection with
Dhantala P.S case no. 108 of 2019 dated 26.3.2019 under Sectionsections
498A/Section326/Section307/Section304B of the Indian Penal Code
and
Allowed In Re : Pabitra Biswas @ Prabitra Biswas Anr. …… petitioners

Heard the learned advocates appearing for the respective
parties.

Having considered the materials in the case diary and
bearing in mind the extent of complicity of the petitioners,
parents- in-law of the victim housewife, who allegedly resided in
the State of Assam at the time of incident and as there is no
complicity of the petitioners in the alleged crime as transpired
from the dying declaration of the victim and since the principal
accused is in custody, we are inclined to grant anticipatory bail to
the petitioners.

Accordingly, we direct that in the event of arrest, the
petitioners shall be released on bail upon furnishing a bond of
Rs. 10,000/- each with two sureties of like amount each, to the
satisfaction of the Arresting Officer and also subject to the
conditions as laid down under Sectionsection 438(2) of the Code of
Criminal Procedure, 1973 and that the petitioners shall appear
before the court below and pray for regular bail within four weeks
from date.

The application being CRM 6494 of 2019 is disposed of.
