And

In Re: Bikash Chowdhury ….. petitioner

Mr. Rameshwar Sinha
…..for the petitioner

Md. Kutub Uddin
….for the State

Report filed in Court be kept with record. It appears from the

report that some of the streedhan articles have been recovered.

Learned Counsel appearing for the defacto complainant submits

that further streedhan articles including gold ornaments are yet to be

recovered.

Bearing in mind the nature of allegations and as investigation has

substantially progressed, we are of the opinion though custodial

interrogation of the petitioner is not necessary, he shall co-operate with

investigation in accordance with law and he may be granted

anticipatory bail.

Accordingly, we direct that in the event of arrest the petitioner

shall be released on bail upon furnishing a bond of Rs.10,000/-, with

two sureties of like amount each, to the satisfaction of the arresting

officer and also be subject to the conditions as laid down under Section
2

Section438(2) of the Code of Criminal Procedure, 1973 and on further condition

that he shall meet the investigating officer once in a week until further

orders and shall appear before the court below and pray for regular bail

within a period of four weeks from date.

This application for anticipatory bail is, thus, allowed.
