In Re:- Sk. Fariduddin and others
… Petitioners

Mr. Shiladitya Banerjee
… for the petitioners

Mr. Iqbal Kabir …for the State

The petitioner seeks anticipatory bail in connection with Uluberia Police

Station Case No. 616 of 2018 dated 16.08.2018 under Sections

498A/406/323/325/506/34 of the Indian Penal Code.

The petitioner claims that the de facto complainant has left the

matrimonial home following a minor incident with the husband.

The State refers to the case diary and the statements of the complainant.

There does not appear to be any report of any serious injury. The de facto

complainant is married to the petitioner no.1 for nearly 15 years.

Considering the material against the petitioner, there does not appear to be

any need to take the petitioners into custody.

Accordingly, in the event of arrest, the petitioners will be granted bail upon

furnishing a security of Rs.10,000/- (Rupees ten thousand only) each, with two

down in Section 438 (2) of the Code of Criminal Procedure, 1973. In addition,

the petitioners will also report to the Investigating Officer at such time and place

as may be specified by the concerned police officer.

The prayer for anticipatory bail is allowed subject to the conditions as

indicated above.

A certified copy of this order be immediately made available to the

petitioners subject to compliance with all requisite formalities.
