Heard learned counsel for the petitioners and learned Public

Prosecutor. Perused the material available on record.

These bail applications under Section 439 Cr.P.C. have been

preferred on behalf of the petitioners who are in custody in

connection with F.I.R. No.222/2016, registered at Police Station

Mahila, Bikaner for the offences under Sections 498A, 304B and

302 IPC.

The first bail application preferred on behalf of the petitioner

Vijay Singh was rejected by this Court giving him liberty to move

a fresh one after examination of Ranjeet Singh (father of

deceased smt. Rekha) and Smt. Parvati (mother of deceased) at

trial. Both these witnesses upon being examined by the trial court,

did not support the prosecution story and were declared hostile.

In this background and having regard to the facts and

circumstances available on record but without expressing any

opinion on the merits of the case, this Court is of the opinion that

the petitioners deserve to be released on bail.

Accordingly, these bail applications under Section 439 Cr.P.C.

are allowed and it is directed that the petitioners (1) Dileep Singh

and (2) Vijay Singh arrested in connection with the F.I.R. No.

222/2016, registered at Police Station Mahila, Bikaner shall be

released on bail provided each of them furnishes a personal bond

of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the

satisfaction of the learned trial court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so.

A copy of this order be placed in each file.
