Prayer in this petition is for grant of anticipatory bail to the

petitioner in FIR No. 35 dated 05.06.2016 registered under Section

498A/406/323/324/506/120-B IPC at Police Station City Ahmedgarh,

District Sagrur.

The above said FIR was registered at the behest of respondent

No. 2 due to matrimonial discord with the petitioner. It is informed that

Section 307 IPC has been added again on 05.04.2017. Section 307 IPC had

earlier been deleted in the inquiry conducted by the police. On oral request

of learned counsel for the petitioner, Section 307 IPC is added in the

headnote and the prayer clause of this petition in addition to the Sections

mentioned therein. Necessary addition be made by the Registry of this

Court.

Learned counsel for the petitioner submits that the matter has

been amicably resolved between the parties in the interregnum. CRM-M

No. 14698 of 2017 has been filed for quashing of the above said FIR. The

matter is yet to be listed for hearing.

Learned counsel for the State, on instructions from ASI

Surinder Kumar affirms that the petitioner has joined investigation pursuant

to order dated 21.11.2016 passed by this Court. It is submitted that a

Photostat copy of the settlement dated 18.04.2017 has been supplied to the

investigating officer. CRM-M No. 37603 of 2016 filed by the co-accused

Sher Mohd. has been been allowed on 16.03.2017.

Keeping in view the facts and circumstances noted above as

well as the settlement arrived at between the parties but without expressing

any opinion on the merits of case, it is considered just and expedient to

allow this petition. Consequently, order dated 21.11.2016 is made absolute.
