This bail application under Section 439 Cr.P.C. is filed by

accused petitioner arising out FIR No.40/2017, Police Station

Surpaliya, District Nagaur for offence punishable under Sections

498A 406 IPC. Police after investigation has submitted charge-

sheet in the matter for the aforesaid offence against the petitioner.

I have heard learned Senior Counsel, learned Public

Prosecutor and learned counsel for the complainant and perused

the materials available on record including Autopsy Report of the

deceased.

Having regard to the facts and circumstances of the case,

without expressing any opinion on merits of the case, I feel

persuaded to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is

allowed and it is ordered that accused-petitioner Dinesh Tarad S/o

Shri Girdhariram arrested in connection with F.I.R. No.40/2017,

Police Station Surpaliya, District Nagaur may be released on bail;

provided he furnishes a personal bond of Rs.50,000/- with two

surety bonds of Rs.25,000/- each to the satisfaction of learned

trial Court with the stipulation to appear before that Court on all

dates of hearing and as and when called upon to do so.
