Main Case

By this common order, I shall be disposing of CR Nos.5359 and

7911 of 2015 as both the revision petitions are arising out of the order passed by

the Court determining maintenance pendente lite at the rate of Rs.18,000/- per

month.

Husband has filed a petition for reduction thereof, whereas wife has

filed a petition for enhancement of maintenance pendente lite.

In the petition filed by husband, this Court while issuing notice of

motion had stayed payment beyond Rs.12,000/- per month as maintenance

pendente lite.

In the currency of the present revision petition, the main petition

filed by the husband under Section 11 of the Hindu Marriage Act, 1955 has been

allowed vide judgment dated 23.08.2017. Certified copy of the judgment has been

placed on file.

In view of the subsequent development, it will be open for the wife

to file an application under Section 24 of the Hindu Marriage Act in an appeal to

be filed against the main judgment.

These revisions are arising out of interim order passed by the Court.

Once the main petition itself has been decided, in my opinion no useful purpose to

be served by keeping the revision petitions pending.

Counsel for the husband has stated that he has already paid

maintenance pendente lite at the rate of Rs.12,000/- per month. The interim order

passed by this Court dated 04.09.2015 is made absolute only for the purpose of

decision of the revision petition. The wife shall be entitled to move an application

under Section 24 of the Hindu Marriage Act in an appeal if she is so advised.

Accordingly, both the Civil Revision petitions are disposed of.
