Heard learned counsel for the applicants and learned A.G.A. for the State.

It is submitted by learned counsel for the applicants that the present dispute is essentially a dispute relating to constrained marital relations, which may be settled between the parties by way of Mediation Centre of this Court.

Considering the facts and circumstances of the case and submissions of the learned counsel for the applicants, let the matter be referred to Mediation Centre.

It is directed that applicants shall deposit a sum of Rs. 15,000/- within one week from today with the Mediation Centre of which 75% shall be paid to the opposite party no.3 for appearance before the Mediation Centre.

Issue notice to opposite party no.2 returnable at an early date.

It is clarified that in case the applicants deposit Rs.15,000/- as indicated above, in the account of Mediation and Conciliation Centre, High Court, Lucknow, within a period of one week from today. Out of the aforesaid amount, a draft of Rs.11,250/- in the name of opposite party no.2 shall be handed over to her on her first appearance. The applicant no. 1 and opposite party no. 2 shall appear before the Mediation Centre on 15.12.2017.

List on 07.03.2018 before the regular Bench with report of the Mediation Centre, if any.

Till the next date of listing, no coercive action shall be taken against the applicants in Criminal Case No. 890 of 2017, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P. Act, Police Station Mahila Thana, District Lucknow, pending in the Court of Special Additional Chief Judicial Magistrate (A.P.), Lucknow.

In case, the aforesaid amount is not deposited, the interim order shall automatically stand vacated without any reference to this Court.
