applicant.

Heard.

Applicant is seeking regular bail in
connection with Case Crime No. 113 of
2016, relating to offences punishable
under section 377 IPC, registered at P.S.
Police Station Vasant Vihar, District
Dehradun.

Learned counsel for the applicant
submitted that FIR has been registered by
the wife (complainant) of the applicant
with the allegation that after their
marriage, the applicant committed
sodomy with the complainant without her
consent. After lodging of the FIR,
applicant was arrested and he is in jail.
Thereafter parties i.e. husband and wife
(complainant) settled their dispute by way
of written agreement and it was agreed
that applicant will pay Rs. 9 lac as full
and final settlement of maintenance and
permanent alimony. It is further
submitted that in case applicant is
granted bail, he will never misuse the
same.

Considering the submission of the
learned counsel for the applicant, after
going through the papers record and
without expressing any opinion as to the
final merits of the case, this Court is of
the view that applicant deserves bail.

The bail application is allowed. Let
applicant Dr. Mohd. Margoob Ahmed be
released on bail on executing personal
bond and furnishing two reliable sureties,
each of the like amount to the satisfaction
of the Magistrate concerned.

Let a certified copy of the order be
issued today itself.
