CrimeNo.1918/2017ofKayamkulamPoliceStation,Alappuzhadistrict,
registeredforoffencespunishableunderSecs.498A,37734SectionoftheIndianPenal
Code,whichhasledtotheinstitutionofAnnx.A-IIfinalreportin
C.C.No.558/2018onthefilesoftheJFCM,Kayamkulam.Itisstatedthatnowthe
entiredisputesbetweenthepetitionersandthe3rdrespondentdefacto
complainanthavebeensettledamicablyandthatthe3rdrespondenthasswornto
Anx.A-IIIaffidavitbeforethisCourt,whereinitisstatedthatshehassettledthe
entiredisputeswiththepetitionersandthatshehasnoobjectionforquashment
oftheimpugnedcriminalproceedingspendingagainstthepetitioners.Itisinthe
lightoftheseaspectsthatthepetitionershavepreferredtheinstantCrl.M.C.with
theprayertoquashtheimpugnedcriminalproceedingsagainstthem.
2.Inacatenaofdecisions,theApexCourthasheldthat,inappropriate
casesinvolvingevennon-compoundableoffences,theHighCourtcanquash
prosecutionbyexerciseofthepowersunderSec.482oftheSectionCr.P.C.,iftheparties
havereallysettledthewholedisputeorifthecontinuanceoftheprosecutionwill
notserveanypurpose.Here,thisCourtfindsarealcaseofsettlementbetween

thepartiesanditisalsofoundthatcontinuanceoftheprosecutioninsucha
situationwillnotserveanypurposeotherthanwastingtheprecioustimeofthe
court,whenthecaseultimatelycomesbeforethecourt.Onaperusalofthe
petitionandonaclosescrutinyoftheinvestigationmaterialsonrecordandthe
affidavitofsettlementandtakingintoaccounttheattendantfactsand
circumstancesofthiscase,thisCourtisoftheconsideredopinionthatthelegal
principleslaiddownbytheApexCourtinthecasesasinSectionGianSinghv.State
ofPunjabreportedin2013(1)SCC(Cri)160(2012)10SCC303and
SectionNarinderSinghandothersv.StateofPunjabandanr.reportedin
(2014)6SCC466,moreparticularlyparagraph29thereof,couldbeappliedin
thiscasetoconsidertheprayerforquashment.
3.Accordingly,itisorderedintheinterestofjusticethattheimpugned
Anx-AIFIR,inCrimeNo.1918/2017ofKayamkulamPoliceStation,Alappuzha
district,whichhasledtotheinstitutionofAnnx.A-IIfinalreportin
C.C.No.558/2018onthefilesoftheJudicialFirstClassMagistrateCourt,
Kayamkulamandallfurtherproceedingsarisingtherefrompendingagainstall
theaccusedwillstandquashed.
Withtheseobservationsanddirections,theaboveCriminal
MiscellaneousCasestandsfinallydisposedof.
