The petitioner-husband aggrieved over an order dated

19.01.2018 of the Court of learned Civil Judge, Junior Division, Ludhiana

passed in a petition under Section 24 of the Hindu Marriage Act ( in short,

‘the Act’) filed in petition for restoration of conjugal rights under Section 9

of the Act has challenged the same before this Court.

Heard learned counsel for the petitioner and perused the

records of the case. In the application for interim maintenance by virtue of

Section 125 Cr.P.C the wife has levelled allegations that respondent-

husband was able bodied person and has kothi valued at Rs.1 Crore besides

two shops under construction and is serving at KFC at West end Mall

Ludhiana and receiving salary of Rs.20,000/- per month. The Court

considering the same had come to the conclusion that grant of maintenance

pendente lite and litigation expenses to the tune of Rs.4000/- was wholly

justified. Learned counsel for the petitioner though has argued with much

vehemence but could not satisfy this Court how grant of maintenance

pendente lite and litigation expenses to the tune of Rs.4000/- per month

was on the higher side keeping n view the ever increasing trend of prices of

the essential commodities and the fact that the wife needs roof over her head

and has to meet her other subsidiary expenses. Since the husband is

bestowed with immovable properties, an earning hand and is able bodied

person, learned counsel for the petitioner could not convince how this

meagre amount needs intervention by this Court. Thus, the petition being

hopelessly without any merits stands dismissed in limine.
