This is an application under Section 389(2) of the Code of Criminal Procedure praying for enlarge on bail till
the hearing of the appeal preferred by them against the judgment and order dated 25th July, 2017 passed by the learned
Additional Sessions Judge, 5th Court, Burdwan in Sessions Case No. 27 of 2016 corresponding to Sessions Trial No. 10
of 2016 thereby convicting and sentencing the appellants for the offence punishable under Sections 498A/306 of the
Indian Penal Code and sentencing them to suffer rigorous imprisonment for three years and to pay fine of Rs. 1000/-
each, in default to suffer further rigorous imprisonment for a period of six months for the offence punishable under
Section 498A IPC and also sentencing to suffer rigorous imprisonment for a period of seven years and to pay a fine of
Rs. 4,000/- each in default to suffer simple imprisonment for a period of six months for the offence punishable under
Section 306 IPC and both the sentences will run concurrently.
Having heard the learned counsel for the appellants and the State and having considered the judgment and
giving an anxious consideration to the facts and circumstances of the case based on the evidence place before me, I do
find that there is arguable case of the petitioners/appellants.
Accordingly, it is directed that pending hearing of the appeal, let the appellants be admitted on bail to the
satisfaction of the learned Chief Judicial Magistrate, Burdwan, on a bond of Rs. 10,000/- each with two sureties of Rs.
5,000/- each, one of whom must be local.
The application for bail being CRAN 4315 of 2017 is, thus, disposed of.
