In the matter of an application for bail under Section 439 of the Code of Criminal
Procedure filed on 01.02.2019 in connection with Gangnapur P.S. Case No. 107
of 2018 dated 17.06.2018 under Sections 498A/304B/34 of the Indian Penal Code.

The learned Advocate appearing on behalf of the petitioner submits
that the petitioner is the husband of the victim/deceased. He is renewing his
prayer for bail. He submits that although initially a case was started under
Section 302 and 498A of the Penal Code, a charge sheet was submitted
only for 304B and 498A of the Penal Code. He submits that even after a
lapse of six months from the submission of the charge sheet, no progress
has taken place in the proceedings before the learned Court below. He
further submits that the mother-in-law, a co-accused in this case, was on bail
and aunt-in-law another co-accused was absconding.
The learned Advocate appearing on behalf of the State submits that
there are sufficient materials in the case diary as against the present
Having considered the materials in the case diary, which disclose the
prima facie involvement of the petitioner in the alleged assault, we are of
opinion that this is not a fit case for grant of bail to the petitioner. However,
the learned Court below is directed to expedite the proceedings for early
commitment of the case.
The application for bail is accordingly rejected at this stage.
Urgent photostat certified copy of this order may be supplied to the
parties expeditiously, if applied for.
