This is an application, filed under Section 438 Cr.PC, praying for pre-arrest bail of the
petitioner, namely, Shri Ananta Kumar Bora, in connection with Dibrugarh PS Case No.
1277/2019 under Sections 448/Section376/Section511/Section354 IPC.
Heard Mr. P.J. Saikia, learned counsel for the petitioner as well as Mr. H. Sarma, learned
Additional Public Prosecutor for the state respondent.
Case diary produced has been perused including the statement of the victim, recorded under
Section 164 Cr.PC.
The victim, in her statement, has implicated the petitioner thoroughly with the commission of
the alleged offences particularly the offence under Section 354 IPC. On reading the materials
in the case diary, it appears that directly or indirectly, the petitioner is in a position to

influence the students of the institute because of his proximity with the administration there.
Such being the materials, this court is not inclined to grant pre-arrest bail to petitioner and
accordingly, his prayer is rejected.
The petition stands disposed of accordingly.
