Prayer in the present petition filed under Section 438 of the
Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the
petitioner in case FIR No.98 dated 05.12.2018 under Sections 323/Section34/
Section406/Section498A/Section506 IPC registered at Police Station Women Cell (West),
Gurugram, District Gurugram.
Learned counsel for the petitioner states that pursuant to order
dated 13.02.2019 of this Court, the petitioner has joined investigation. He
has referred to Annexure P-2 to show that the dowry articles have been
handed over to the complainant.

Learned State counsel, on instructions from ASI Jaipal Singh,
does not dispute the fact that the petitioner has joined the investigation.
However, she submits that the complainant has not supplied the bills in
support of the jewellery articles.
I have heard learned counsel for the parties.
Considering the fact that the petitioner has joined investigation
and the complainant has not supplied the bills in support of the jewellery
articles to be recovered, the present petition is allowed and the interim
order dated 13.02.2019 is made absolute.
However, the petitioner shall join the investigation as and
when directed by the investigating agency and shall abide by the terms and
conditions laid down under Section 438(2) Cr.P.C.
